Conditions of sale

 

CONTRACT

By ordering products online (hereinafter « product(s) ») from Saint-Joseph’s Oratory of Mount Royal (hereinafter « Oratory » or « we » or « us »), you (hereinafter « buyer » or « you » or « your ») agree that the present terms of sale (hereinafter « terms ») constitute a binding contract between you and the Oratory governing the purchase (hereinafter « purchase ») of the products.

 

PRICE

All product prices are indicated in Canadian currency. Prices are liable to change without notice and at the Oratory’s discretion.

 

TAXES AND DELIVERY FEES

Prices exclude taxes, transportation costs and delivery fees. It is the buyer’s responsibility to pay any taxes, fees, duties, transportation costs, delivery fees and all other expenses relating to the sale and the delivery of the products by the Oratory to the buyer.

 

DELIVERY

The products are delivered by a third-party transporter to the address that you have given us. Products are remitted for delivery to the transporter within seventy-two (72) business hours following the receipt of your payment by the Oratory. Delivery costs are not included in the product price and appear as a separate price from the product price on the invoice. The delivery costs must be paid at the same time as the product price. Estimated delivery times are approximate and the Oratory does not guarantee delivery within that delay. The buyer releases the Oratory from all responsibility for damages, losses, or potential expenses that may result from the difference between the estimated and the actual delivery time.

 

RETURN OF PRODUCTS

To return a product, you must do so within five (5) days from the date you receive it. You must return the product in its original packaging and ensure that it is well packaged, as the Oratory will not provide reimbursement for any damaged products. You may choose the return delivery mode you want, however it is suggested that you choose a delivery mode that can be tracked. After receipt and review of the returned product, we will proceed with the reimbursement of your order on the credit card that was used to purchase the returned product. Take note that return transportation costs are not reimbursed by the Oratory and remain your responsibility.Gold and silver jewelry is not refundable or exchangeable.

 

DAMAGED PRODUCTS

The Oratory pays great attention to the preparation and delivery of its products. However, if a delivery is incomplete or damaged, please contact us, by email or telephone, within seventy-two (72) hours of your receipt of the order. All returns of damaged products require the prior approval of the Oratory. If the Oratory accepts the return of the damaged product, it will replace it as soon as possible. If the Oratory cannot replace the product, it will reimburse the amount of your order and delivery fees, if any.

 

CHANGES OR CANCELLATIONS OF ORDERS

All changes or cancellations to an order must be made in writing and approved by the Oratory.For any information about our products, to return a product, to change or cancel your order, please contact us :

QUANTITY

The Oratory does not guarantee that a product will always be available. The Oratory reserves the right to cancel an order if the product is out of stock and reimburse you, as the case may be. All images, pictures and descriptions contained on the Oratory’s website are based on available information at the time of publication. We reserve the right to change, at all times and without prior notice, our prices, descriptions, images and politics indicated on the website. Such changes will not affect orders.

 

PERSONAL INFORMATION

You agree that the Oratory may use the personal information collected about you on our website, namely your name, address, email address, phone number, credit card number and other financial information (hereinafter « personal information »), for the purposes set out in the following paragraph.You also agree that the Oratory may disclose your personal information to individuals and organizations likely to use your personal information to ensure the best service pre-purchase and post-sales (hereinafter “authorized providers”). The authorized providers consist of the Oratory, Woo Commerce, PayPal, Stripe, and Canada Post. These authorized providers allow for:

a. the handling of the purchase and the payment;
b. the invoicing and billing payments;
c. the delivery of the products;
d. direct contact with you regarding your purchase and to advise you of other products and services available which could be available;
e. to provide effective customer service and obtain your comments to this effect;
f. remitting applicable taxes, and;
g. compliance with legal requirements.

In providing your personal information, you accept that the authorized providers use the present consent in order to comply with legal requirements. You accept and recognize that your personal information can be kept outside of the province of Quebec or Canada.

LIMITATION OF LIABILITY

The Oratory is not responsible for damages caused by misuse of the products. Subject to applicable law, in no event shall the Oratory’s liability exceed the price paid by the buyer for the products.

 

GUARANTEE LIMIT

Subject to applicable law, the Oratory does not guarantee that the products purchased by the buyer are designed for a special purpose or a specific application. It is the buyer’s responsibility to ensure that the products correspond to the desired use and to implement security measures required for their use.

 

REGULATORY REQUIREMENTS

It is the buyer’s sole responsibility to determine whether a product conforms to the legal requirements that may apply to its intended use.

 

INDEMNIFICATION BY THE BUYER

Subject to applicable law, the buyer undertakes to indemnify and hold harmless the Oratory, its affiliates, customers, contractors, employees, directors, officers, consultants and other representatives from all liability, claims, actions, proceedings, losses, expenses or all damages (including all costs and judicial and extrajudicial fees) caused or related to the use of the products by the buyer, its affiliates, related entities, contractors, customers, employees, directors, officers, consultants and other representatives.

 

EXPORT

The Oratory cannot be held responsible for any fine, fee, levy, costs or claims arising from third parties resulting from the export of products outside of Canada.

 

REPORTED DATA

Subject to applicable law, all units of measurement, such as weight and dimensions are approximate.

 

INTERPRETATION

The present terms are governed by and construed in accordance with the laws of the Province of Quebec. The Oratory and the buyer agree to submit to the exclusive jurisdiction of the courts of the Province of Quebec. In addition, the implementation of the United Nations Agreement on Contracts for the International Sale of Goods is excluded.

 

GENDER AND NUMBER

In the present terms, the masculine includes the feminine and the plural includes the singular.

 

SEVERABILITY

If any provision of the present terms is invalid or unenforceable by a Court, that provision shall have the effect determined by that Court. The remaining provisions of these terms shall continue to be valid and enforceable as if the invalid or unenforceable provision had never been part of these terms.

 

NON-WAIVER

The silence, negligence or delay of the Oratory to exercise a right or remedy under these terms shall not, under any circumstances, be interpreted or construed as a waiver of its rights and remedies; the Oratory may exercise its rights as long as the contractual or legal prescription provided for the exercise of such right or remedy has not expired. No waiver of the terms shall be valid unless in writing and signed by a duly authorized representative of the Oratory. Such waiver shall not constitute a waiver of any other provision.
